New decree on employing foreigners in Vietnam

VietNamNet Bridge – The Government has issued a decree on the recruitment and management of foreign employees in Vietnam.

Decree 34/2008/ND-CP, which was issued on March 25, is applied to foreigners working in Vietnam and Vietnamese businesses and organisations employing foreigners.

The decree stipulates that foreigners working in Vietnam must be aged over 18 and their health must meet their jobs’ requirements. They are managers, executive directors or experts directly in charge of businesses that have set up their trade presence in the country.

Employers is permitted to use foreigners who neither has previous conviction of national security violations nor is being held responsible for crimes or serving penal sentence under the Vietnamese and any foreign country’s laws, said the decree.

Foreign employees must have working licence given by authorised Vietnamese agencies excluding those who do not need to be licensed as regulated.
