NA Judicial Committee discusses Penal Code

This vital law will have major effects on national socio-economic development and will attract public concern, said Chairwoman of the NA’s Judicial Committee Le Thi Nga.

Presenting a submission to the Government on the amendment and supplement of the Penal Code No 100/2015/QH13, Deputy Minister of Justice Dinh Trung Tụng said the current Penal Code was approved by the 12th National Assembly and was effective since July this year.

However, Tụng said, during implementation, authorities discovered several errors, including some regulations that could be unsuitable for reality.

Deputy Justice Minister Tung revealed there were two views on the amendment and supplement for the Penal Code.

The first was determining the amendment and supplement to the Penal Code based on review of the law but without effecting macro policies mentioned in the law that were approved by the 13th NA, according to Tụng.

The second view held that it was necessary to deal with errors and irrelevant regulations of the Penal Code, even totally modifying it if necessary.

The modification should help solve issues in quantifying the details of the Penal Code, especially the definition of consequences effecting human life, health and property as well as treatment and definition of criminal liability.

The National Assembly Standing Committee directed the Judicial Committee in co-ordination with the Ministry of Justice, Ministry of Public Security, the Supreme People’s Court, People’s Procuracy and other relevant authorities to review the provisions of the criminal Code to ensure a comprehensive implementation of the Penal Code.

Head of the People’s Procuracy of Ho Chi Minh City Duong Ngoc Hai said he was anxious that after reviewing the Penal Code for a short time, authorities found 141 articles that needed to be adjusted and supplemented.

According to Hai, if a closer and more careful review was undertaken, there might have been a lot more errors.

“With such a vast number of errors, there could be more serious consequences,” said Hai.

Discussions on the Penal Code will continue today, with the draft Anti-Corruption Law also on the table.
